Film & Television

 

One of Neil’s more challenging projects was negotiating the publishing and motion picture rights for the acclaimed movie 'Taking Woodstock' directed by Oscar winner director Ang Lee and starring Emile Hirsch, Liev Schreiber, Eugene Levy, Jonathan Groff, Imelda Stauton and Demetri Martin. Other notable film projects include Love Child (HBO), Welcome to Leith (PBS), Me at the Zoo (HBO) and Susanne Bartsch on Top (Netflix) and reality tv shows. 

Neil's film practice includes negotiating and preparing option rights agreements, production contracts, international distribution agreements, talent and investor agreements. He is also involved in litigation concerning film issues including copyright infringement, rights of publicity/privacy, defamation and idea submissions.


Intellectual Property

 

Neil has extensive experience in all facets of intellectual property law including trademarks, copyrights, licensing, trade secrets, trade dress, internet and domain names. He regularly advises on trademark and copyright registration, chain of title review, infringement issues and fair use analysis. Neil regularly represents clients in trademark and copyright filings, opposition and cancellation proceedings before the Trademark Trial and Appeal Board and in UDRP domain name disputes. One of Neil’s more well known cases involved representing fashion designer Kate Spade in disputes with the Banana Republic, Fashion Express and the Gap.  Neil was also involved in providing key advice and analysis to Tommy Hilfiger in the landmark case involving the Star Class Yacht Racing Association.  

Neil’s practice includes advising clients world-wide on how to protect and defend their business interests by effective use of copyrights, trademarks and other intellectual property. He has had the privilege of representing some of the most prestigious fashion brands and companies in the United States.  


Music

 

Neil has also represented top talent in the recording industry including Grammy award winning artists and Rock Hall of Fame recording artists. In the music field, he has handled numerous  artist-manager disputes, royalty accounting issues, recording artist and publishing agreements, band membership contracts, guild arbitrations and copyright litigations involving music. Neil recently obtained a large monetary settlement for a famous recording artist in an arbitration involving music used in a national television commercial. Another notable achievement involved winning copyrights back in  a contract dispute involving a rising song writer signed to a publishing deal with a famous music producer.       


Litigation &
Dispute Resolution

 

Neil is admitted to practice in New York, the U.S. District Courts, Southern, Eastern and Northern Districts of New York and the United States Court of Appeals for the 2nd Circuit. He has also been admitted in infringement cases as counsel representing clients in cases in U.S. District Courts of California and Massachusetts.  Neil regularly represents clients in opposition and cancellation proceedings before the Trademark Trial and Appeal Board and in domain name disputes. Neil recently successfully defended several clients in various copyright infringement cases commenced by copyright trolls involving use of photographs.
